Temporary Disability
As an injured worker, you are entitled to compensation payments while you are unable to work due to your injury. Thus if you do not miss time from work as result of your injury you do not receive payments. If your doctor declares you temporary totally disabled and “off work” you are entitled to 2/3 of your average weekly wage. There is a three day waiting period to receive TD payments unless you are hospitalized.
There is a state maximum depending on your date of injury. As of January 2009, the state maximum(which will be 2/3 of your average weekly wage) is $958.01. Also depending on your date if injury the amount if weeks you are entitled to varies. For example, if you were injured between the periods of April 19 2004-Dec 31 2008, your temporary disability payments start from the first day issued and run continuously for 2 years whether or not you have returned to work and and payments have stopped in between, thus you may not receive a full two years.
If your injury is from Janurary 1, 2008 and on you are entitled to 104 weeks of TD which does not run continuously. For example, if you are on and off work for two years, your TD will be done when you have received all 104 weeks of payments.
