Increase in Penalties against Employers

Last week a bill was passed that will increase the penalties owed by employers who fail to provide worker’s compensation benefits to injured workers. The increase will be from $1,000 to $1,500 and will take effect January 2011. The idea is to discourage employers from not providing benefits with the assumption they will pay a hefty penalty otherwise. All it needs is the governor’s signature.

Plant closings or mass layoffs require advance notice to employees.

Harvey Sohnen, an employment and business law attorney with Sohnen and Kelly located in Orinda recently noted, “The Federal Worker Adjustment and Retraining Notification Act (WARN) requires advance notice or pay in lieu of notice in some cases where plant closings or mass layoffs occur.”  So, if you have been laid off or are anticipating losing your job, you may have rights under WARN.

Free eyeglasses for Children 12 Years and Under

Target is having a special promotion for their optical service. This promotion can end at any time and will definitely end by April 29th.
Parents of children 12 years and younger can get a free pair of glasses from Target. All you need to do is bring in a valid prescription for glasses from their doctor and Target will let the child pick from around 40 different frames. Target will place their best lenses in the frame which are non-glare and scratch resistant that normally sell for $200. There are no income guidelines so any child 12 years or younger is eligible. You may find Target stores with optical departments at www.target.com and call and confirm that they are participating in this promotion before making a trip to the store.

Foreclosures

As the down turn in the housing market continues, many clients are facing foreclosure. It is important to know that just because the community stopped paying the mortgage, does not mean that the party occuping the home is not obligated to pay reasonable rent to continue occupying the residence. Simply put, it you live in the house, you should expect to pay rent whether the mortgage is paid or not.

Unemployment Benefits

Good News! As part of the Stimulus Package, unemployment benefits are expected to rise by $25 per week or on average $100 per month. Keep this change in mind when calculating support payments.
